1. Purpose and scope
These Terms and Conditions of Sale ("Terms") govern every sale of products offered on lumea-brand.com ("the Site") by LUMEA ("we", "us") to a consumer buyer ("you", "the Customer"). Placing an order means you accept these Terms in full. We may change them at any time; the version in force is the one published on the Site on the date your order is placed. The Site sells to customers in the United States, Canada, the United Kingdom and Australia. Products are intended for personal, non-professional use.
2. Products
We sell LED light-therapy masks and related accessories for face and neck care. Product photographs, descriptions and packaging shown on the Site are as accurate as we can make them but are illustrative; minor differences in shade, packaging or accessories do not constitute non-conformity.
Health notice. Our products are cosmetic devices, not medical devices. They do not diagnose, treat, cure or prevent any disease. Read the instructions before use. If you are pregnant, have a photosensitive condition, epilepsy, an eye condition, or take photosensitising medication, consult a healthcare professional before use. Do not use on broken or irritated skin. Nothing on the Site replaces medical advice.
3. Prices
Prices are shown in US dollars (USD) on the product page and include all taxes due by us. As we operate under the French micro-entreprise VAT exemption (Article 293 B of the French General Tax Code), no VAT is charged on our prices. Shipping costs are shown separately before you confirm the order.
Import duties and taxes. For deliveries outside the European Union, local customs duties, import VAT/GST or handling fees may be charged by the destination country. Unless the checkout page states that duties are prepaid, these charges are payable by the Customer and are not included in our prices.
We may change our prices at any time. The price applicable to your order is the one displayed at the moment you confirm it.
4. Orders
The order process is: selection of products, basket, entry of delivery and billing details, choice of shipping method, payment, confirmation. Before payment you can review and correct your order. Clicking the payment button constitutes a firm order. The sale is concluded when we send you an order confirmation email. We may refuse or cancel an order in the event of an obvious pricing error, a suspicion of fraud, an unpaid earlier order, or stock unavailability; in that case any amount already paid is refunded in full.
5. Payment
Payment is due in full at the time of the order, by the methods offered at checkout. Transactions are processed by our payment providers over a secure connection; we never store your full card details.
6. Delivery
Destinations: United States, Canada, United Kingdom, Australia.
Dispatch: orders are processed within 1–3 business days.
Estimated delivery time: 7 to 20 business days from dispatch, depending on destination and carrier. These are estimates, not guaranteed dates. Some items ship directly from our suppliers' warehouses and an order may arrive in more than one parcel.
Tracking: a tracking number is emailed to you when your parcel ships.
Delay. If your order has not arrived within 30 days of the confirmation email, contact us and we will investigate, then reship or refund. Where the law of your country of residence gives you a right to cancel for late delivery, that right applies.
Wrong address. Please check your delivery address carefully; we are not responsible for parcels lost because of an incorrect or incomplete address, but we will help you trace them.
Damaged parcels. Note any visible damage on the carrier's delivery record where possible and tell us within 7 days, with photographs.
7. Right of withdrawal — 14 days
You may cancel your order and return the product within 14 days of receiving it, without giving a reason. To do so, email yan3ouri@gmail.com with your order number and a clear statement that you are withdrawing. We will confirm the return address. Return the product within 14 days of that notice, complete, unused where possible, and in its original packaging with all accessories.
Return shipping costs are payable by the Customer unless the product is faulty, damaged or not what you ordered.
We refund the price paid, and the standard outbound shipping cost, within 14 days of receiving the returned product (or of proof that you have sent it), using the same payment method. Where a product has been used beyond what is needed to inspect it, we may reduce the refund to reflect the loss of value.
Exceptions. For hygiene reasons, the right of withdrawal does not apply to products sealed for health protection whose seal has been broken after delivery, nor to products made to your specification.
Customers in the United States and Canada benefit from the same 14-day policy as a contractual commitment. UK customers benefit from the statutory 14-day right; Australian customers keep all rights under the Australian Consumer Law.
8. Faulty products and legal guarantees
Beyond the withdrawal period, if a product is faulty, does not match its description, or fails within a reasonable time, contact us with photographs or a video. We will repair, replace or refund it. Nothing in these Terms limits: for consumers in the European Union, the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code); for consumers in the United Kingdom, your rights under the Consumer Rights Act 2015; for consumers in Australia, the consumer guarantees under the Australian Consumer Law, including the right to a repair, replacement or refund for a major failure; for consumers in the United States and Canada, any non-waivable rights under applicable federal, state or provincial consumer law.
9. Liability
We are liable for foreseeable loss caused by our failure to perform these Terms. We are not liable for loss caused by misuse of a product, failure to follow the instructions, or use contrary to the health notice in Article 2. Our liability is not excluded or limited where the law does not allow it, in particular for death or personal injury caused by our negligence, or for fraud. Delivery obligations are suspended by events of force majeure beyond our reasonable control.
10. Personal data
We process your personal data to handle your order, deliver it, answer your requests and, with your consent, send you marketing messages. The legal basis, retention periods and your rights (access, rectification, erasure, portability, objection, withdrawal of consent) are described in our Privacy Policy. 11. Complaints and dispute resolution
Write to yan3ouri@gmail.com first — most issues are solved within a few days. If no agreement is reached, EU-resident consumers may refer the dispute free of charge to a consumer mediator (médiateur de la consommation); the mediator's details will be provided on request. Consumers may also bring the matter before the competent courts.
12. Applicable law
These Terms are governed by French law. This does not deprive you of the protection of the mandatory consumer-protection rules of the country in which you habitually reside, and you may always bring proceedings before the courts of that country.
13. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions continue to apply. Our failure to enforce a provision is not a waiver of it. These Terms, together with your order confirmation, form the whole agreement between us.
